Le toghe aprono la terza Camera: tutto ciò che un giudice non può essere

L'ampio documento conclusivo del Congresso dell'Anm – quattro pagine di mozione – meriterebbe davvero di essere conosciuto e studiato. Nel senso che in quel testo c'è proprio tutto quello che i magistrati non dovrebbero fare, in uno stato di diritto basato sul principio classico della separazione dei poteri. I magistrati, in primo luogo, non dovrebbero ammonire – meno che mai preventivamente – chili critica: stiamo parlando di funzionari dello Stato che già dispongono dell'immenso potere di limitare la libertà altrui, e che a maggior ragione dovrebbero attenersi a una speciale continenza espressiva, stando rigorosamente fuori dalla polemica politica. E invece, nel documento approvato ieri, si trovano ampi passaggi in cui i magistrati italiani sembrano perfino fissare le condizioni per chi desideri sollevare obiezioni sul loro operato. I magistrati, in secondo luogo, non dovrebbero appellarsi ai cittadini o rivendicare una sorta di rapporto diretto con il popolo, che tra l'altro – diversamente da quanto accade in altri ordinamenti – non li ha eletti. E invece, incredibilmente, la mozione si conclude deliberando una “mobilitazione culturale e comunicativa” contro le riforme annunciate dal governo.
