**Open Arms: Memoria pm, 'non vi era alcun reale e concreto pericolo sicurezza pubblica'**

Palermo, 16 set. (Adnkronos) - "Non vi era alcun reale e concreto pericolo per la sicurezza pubblica che rendesse giuridicamente lecito il rifiuto del POS e il conseguente trattenimento, indiscriminato e collettivo, di una pluralità di naufraghi soccorsi in mare". Lo scrivono nella memoria depositata in cancelleria il procuratore aggiunto di Palermo Marzia Sabella, i pm Giorgia Righi e Calogero Ferrara, dopo la richiesta di condanna a 6 anni di carcere per Matteo Salvini. I pm ricordano le dichiarazioni dell'ex premier Giuseppe Conte e degli ex ministro Trenta e Toninelli. Questi ultimi "hanno chiarito che non era stato loro prospettato, con riferimento alla vicenda Open Arms, alcuno specifico rischio per la sicurezza nazionale e che, in ogni caso, sarebbe stato opportuno fare sbarcare tutti i migranti per procedere alla loro identificazione e svolgere tutti gli accertamenti". "Neppure sono emerse ragioni di ordine tecnico assolutamente impeditive di uno sbarco dei migranti a bordo della Open Arms al porto di Lampedusa, o in altro porto agevolmente raggiungibile. In particolare, la situazione delle presenze all'interno del centro “hotspot” di Lampedusa nel periodo dal 14 al 20 agosto 2019, non risultava oggettivamente ostativa all'accoglienza dei migranti della Open Arms, come si ricava dai dati delle presenze acquisiti in atti e dalle dichiarazioni di numerosi testi".
